1. The ASG said that whatever sections the accused are facing, they can be tried in the NDPS court only. That's why it is not maintainable. I oppose the application of bail of all these. 2. ASG Singh said that WhatsApp chat, meeting the accused on the cruise cannot be a mere coincidence. Their statements reveal that they all met before leaving for the cruise. All these accused have been using drugs in the past also. This is no coincidence.
3. We have strong evidence in the form of WhatsApp chat, which proves that the accused were involved in this conspiracy. Judge sir, it cannot be just a coincidence that the accused meet at terminal 1 and 2.
4. ASG Anil Singh argued that you should think whether the petition is maintainable in this court or not, the hearing on bail will be done after that. For this you have to go to the concerned court.
5. The ASG told the court that you may have a small amount of drugs but you are part of the group. We have their statements recorded, WhatsApp chats also. The football message he talked about also mentions bulk quantities.
6. I am not saying that bail cannot be filed. Everyone has the right to bail. But we are protesting whether this court has the right to claim bail?
7. During the hearing, Anil Singh mentioned the Armaan Kohli case in the court. Armaan Kohli's bail plea was rejected because a large quantity of drugs were recovered from the accused with whom he was arrested.
8. He said that it is the same in this case as well. You may have a small amount of drugs, but you are part of that group.
9. My able friend, citing Article 2-3 from Justice Dangre's decision, said that he is entitled to interim bail. Whereas that decision also says that for this you will have to go to the concerned court.
10. All the accused were arrested in the same type of offence, so they cannot be divided.
